This Privacy Policy (“Policy”) describes how recteq, LLC (“recteq,” “we,” or “us”) treats personal information we collect about you through our websites and platforms where the Policy is located (the “Platform”). This Platform is operated in the United States and intended for use by individuals who are located in the United States.

TYPES OF PERSONAL INFORMATION WE COLLECT

recteq collects personal information from you and about you. Here are some examples of the personal information we may collect:

  • Identifying Information. For example, we may collect your name, address, unique personal identifiers, online identifiers, telephone number and email address. We may also collect your mobile phone number.
  • Account Information. If you create an account on our Platform, we may collect your account log-in and password.
  • Social Media Information. We may collect personal information you post on our social media pages. We may also collect your social media profile information and personal information posted on your page.
  • Payment Information. For example, this may include your billing address, your preferred method of payment, and your payment card type. Through our service providers, we may also collect your credit or debit card information.
  • Commercial Information. We may collect personal information that could identify you and relates to the services in which you are interested or have considered. We may also collect personal information about your consuming history or tendencies.
  • Financing Information. If you finance your purchase with us, we, through our vendors, may collect information required to run a credit or background check.

We might look at what site you came from, or what site you visit when you leave us. We may also collect information about how you interact with an advertisement.

    • Request information aboout our services.

    • Submit a product return.
    • Sign up for recteq Academy class.
    • Submit a financing application.
    • Participate in one of our promotions or contests.
    • Sign up to receive promotional communications or a newsletter.
    • Complete a survey.
    • Leave a product review.
    • Submit information to, or through, our Platform.
    • Submit a request to, or engage with, our customer service team.
    • Interact with our social media pages.
    • Otherwise interact with us.

    • Our business partners, including online advertising networks, analytics vendors, and third parties that promote our products via their own platforms.

  • To Comply With the Law or To Protect Ourselves. For example, this could include responding to a court order or subpoena. It could also include sharing personal information if a government agency or investigatory body requests. We might share personal information when we are investigating a potential fraud.
  • Where You Have Asked Us to Share Your Information with a Third Party.
  • For Other Reasons We May Describe to You At the Time of Collection.
  • SMS opt‑in data and consent status. We will never share, rent, lease, sell, or otherwise disclose your SMS opt‑in status or consent information to any third party—including affiliates—for non-service‑related purposes or any purposes beyond the scope of your explicit consent. This includes confirming that your opt‑in data will not be transferred for marketing, advertising, analytics, or other uses not directly related to sending you the SMS messages you agreed to receive.

CALIFORNIA PRIVACY NOTICE

The California Consumer Privacy Act (“CCPA”), as amended by the California Privacy Rights Act (“CPRA”), requires us to make specific disclosures about how we collect, use, and share the personal information of California residents. CPRA also grants additional rights to such residents. This section describes our personal information practices both offline and online, and contains required disclosures and instructions for California residents who wish to exercise their rights under the law.

Scope:
Please note that, to the extent permitted under CCPA/CPRA, this section does not apply to the personal information of California residents that we collect:

  • From our workforce members for employment-related purposes
  • In the course of certain business-to-business transactions
CATEGORIES OF PERSONAL INFORMATION WE COLLECT

In the past 12 months, we have collected the following categories of personal information as defined by California law:

  • Sensitive personal information (as defined under CPRA), which may include account log-in, financial information, or precise geolocation data if collected

We may disclose any of these categories for “business purposes” as defined under the law.

We do not sell California consumer personal information for monetary or other valuable consideration, and we do not share personal information for cross-context behavioral advertising.

CALIFORNIA RESIDENT RIGHTS UNDER CCPA/CPRA

Subject to certain exclusions and verification, California residents have the following rights under the CPRA:

    • The business or commercial purposes for collecting, sharing, or selling personal information

    You may request that we delete personal information we collected from you, subject to legal exceptions.
  3. Right to Correct
    You may request that we correct inaccurate personal information we maintain about you.
  4. Right to Opt-Out of Sale/Sharing
    While we do not sell or share your personal information in the traditional sense, you may still opt out of the use of tracking technologies that may constitute a "sale" or "sharing" under CPRA definitions. See our About Our Ads policy to manage preferences.
  5. Right to Limit Use of Sensitive Personal Information
    If we collect sensitive personal information, you have the right to limit its use to only necessary business purposes.
  6. Right to Non-Discrimination
    You have the right not to receive discriminatory treatment for exercising your privacy rights.

If you are a California resident, you may also request once per year information about our sharing of your personal information with third parties for their direct marketing purposes. NEVADA PRIVACY NOTICE

If you are a Nevada resident, under Privacy and Security of Personal Information Chapter of the Nevada Revised Statutes Section 603A (“603A”), you have the right to submit a verified request to us, directing us not to make any sale of certain “personal information” as defined under this law that we have collected or will collect about you. As of the date of this Policy, we do not knowingly engage in the “sale” of “personal information” of Nevada residents. This statement is based on our understanding of how the term “sale” is defined under 603A as of the date of this Policy. However, Nevada residents who wish to exercise their rights under this section can contact us by email at privacy@recteq.com. Please indicate you are a Nevada resident making a “Nevada Opt-Out” request.

CHILDREN UNDER 18

The Platform where this Policy is located are meant for adults. We do not knowingly collect personally identifiable data from persons under the age of 18, and strive to comply with the provisions of COPPA (the Children’s Online Privacy Protection Act). If you are a parent or legal guardian and think your child under 18 has provided us with personal information, please contact us at privacy@recteq.com. CHOICES REGARDING YOUR INFORMATION

You have certain choices about how we use your personal information. Certain choices you make are browser and device specific.

Marketing Communications:

You can opt out of receiving our marketing communications. Note that you may still receive transactional messages from us, including information about your account and responses to your inquiries. To opt out of receiving our marketing communications, you can follow the instructions contained in the communication.

Cookies & Other Tracking Technologies:

Cart reminder tracking:

We use cookies, web browser local storage, and similar technologies (such as website plugins and session tracking) to monitor activity in your shopping cart—specifically to detect if items you added are left unpurchased. If you have opted in to receive cart reminder messages, this tracking allows us to send you a timely SMS or email reminder (one per abandoned cart event) within 48 hours. No other personal data collected through these tracking mechanisms will be used or shared for purposes unrelated to these reminders .

SECURITY

The Internet is not 100% secure. We cannot promise that your use of our Platform will be completely safe. We encourage you to use caution when using the Internet. We use physical, technical, and organizational means to help safeguard personal information under our control. A username and password are needed to access certain areas of the Platform. It is your responsibility to protect your username and password. Personal Information may be accessed by persons within our organization, or our third-party service providers, who require such access to carry out the purposes described in this Privacy Policy, or otherwise permitted or required by applicable law.


STORAGE OF PERSONAL INFORMATION

Personal Information we maintain may be stored in or outside of the United States. If you live outside of the United States, you understand and agree that we may transfer your personal information to the United States. This Platform is intended for use in the United States and is subject to the laws of the United States, which may not provide the same level of protections as those in your own country. Personal Information processed and stored in another country, including the United States, may be subject to disclosure or access requests by the governments, courts or law enforcement or regulatory agencies in that country according to its laws.

By using our Platform or by providing us with personal information, you consent to any such transfer of information outside of your country.

Our Platform may contain links to other third-party sites that are not governed by this Policy. This includes third-party sites that offer resources and content which you can access through our Platform. If you click on a link to a third-party site, you will be taken to a site we do not control. We are not responsible for the privacy practices used by third-party sites. Mobile Terms of Service

The recteq mobile message service (the "Service") is operated by recteq (“recteq”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to recteq’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of recteq through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with recteq. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to +18447797519or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other recteq mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
